The Belgian Government has voted a new law obligating all webshops delivering goods on the Belgian territory to offer at least 2 delivery options to their customers.
What does this mean exactly?
For who?
- Every webshop delivering goods on the Belgian territory.
From when?
- Obligated as from 21/09/2024
Possible delivery options?
- Free to choose by the webshop: Home delivery (to a specific address) OR delivery to a Pick-Up Point OR in a Parcel Locker OR in-store delivery,... (e.g. Home delivery offered by 2 different partners (e.g. bpost & other carrier) does not mean the webshop offers 2 different options.)
Exceptions?
- If the only current delivery option is in-store Pick-Up (food groceries/prepared meals, furniture,…)
- Young companies (<3yrs)
- Other (well-founded) reasons (jewelry, valuables, XL goods,…)
- B2B deliveries
Sanctions?
- In case of non-compliance with this law, the online store risks a sanction of ‘Level 2’ = a criminal fine between €26 - €10K or up to 4% of the total annual turnover in the last completed fiscal year prior to the imposition of the fine for which data is available to determine the annual turnover, whichever is higher.
- The webshop always bears the risk, not the carrier.
